1. Agreement to Terms

By accessing and using TourFixer ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use our services.

2. Services Offered

TourFixer provides:

• Private transfer booking services between cities in Uzbekistan
• Local guide connections and booking services
• Travel information and blog content
• Customer review platform

3. Booking and Payments

Booking Process

All bookings are subject to availability and confirmation. We will contact you via your preferred method (WhatsApp, Telegram, etc.) to confirm details and finalize your reservation.

Pricing Structure

All prices displayed on TourFixer include the deposit amount. The total price consists of two parts:

• Deposit: Paid upfront to TourFixer to confirm your booking
• Remaining Balance: Paid directly in cash to the driver or guide upon service completion

Payment Terms

• The deposit amount varies depending on the service and will be communicated during booking confirmation
• Deposit must be paid before the service date to secure your booking
• The remaining balance is paid directly to the driver/guide in cash upon service delivery
• Prices are quoted in USD but can be paid in local currency (UZS) at the current exchange rate after confirmation by the organizer
• All displayed prices include standard fees unless otherwise specified

4. Cancellation and Refund Policy

Deposit Policy

All deposits are strictly non-refundable. By paying a deposit, you acknowledge and agree to this policy.

Cancellation by Customer

• If you cancel your booking for any reason, the deposit will not be refunded
• No-shows (failure to appear at the pickup location) forfeit the full deposit
• Rescheduling requests are subject to availability and may require a new deposit

Cancellation by Service Provider

• If the service provider (driver/guide) cancels, we will arrange an alternative or offer rescheduling
• In rare cases where no alternative is available, the deposit may be refunded or credited to a future booking

5. User Responsibilities

You agree to:

• Provide accurate and complete information when booking
• Be punctual for scheduled pickups (delays may result in additional charges or service cancellation)
• Treat drivers and guides with respect and courtesy
• Follow local laws, customs, and traffic regulations
• Wear seatbelts at all times during transportation
• Pay the remaining balance to the driver/guide upon service completion
• Not submit false or misleading reviews
• Assume personal responsibility for your own safety and belongings

6. Liability and Disclaimer

Platform Role

TourFixer acts solely as a booking platform connecting customers with independent service providers (drivers and guides). TourFixer is not a transportation company, tour operator, or employer of drivers/guides.

Zero Liability for Transportation Incidents

TourFixer assumes absolutely no responsibility or liability for any incidents, accidents, injuries, or damages that occur during transportation or tours. This includes, but is not limited to:

• Vehicle Accidents: Car crashes, collisions, rollovers, or any other traffic accidents, regardless of fault
• Vehicle Breakdowns: Mechanical failures, flat tires, engine problems, or any vehicle malfunctions that occur during service
• Road Conditions: Damage or injury caused by poor road conditions, potholes, construction zones, or unpaved roads
• Personal Injury: Any physical injury, illness, or death occurring during the service
• Property Damage: Damage to your luggage, personal belongings, or any other property
• Lost or Stolen Items: Personal belongings left in vehicles or lost during tours
• Medical Emergencies: Any health-related issues that arise during transportation or tours

Additional Disclaimers

TourFixer is not liable for:

• Delays due to traffic, weather, road closures, or unforeseen circumstances
• Actions, negligence, or misconduct of third-party service providers (drivers/guides)
• Third-party services such as restaurants, hotels, or attractions recommended during tours

Assumption of Risk

By using TourFixer services, you acknowledge that travel inherently involves risks. You voluntarily assume all risks associated with transportation. You agree to hold TourFixer, its owners, employees, and affiliates completely harmless from any claims arising from your use of our platform or services booked through it.

Limitation of Liability

In no event shall TourFixer's total liability exceed the deposit amount paid for the specific service. TourFixer shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

Insurance Recommendation

We strongly recommend that all customers obtain comprehensive travel insurance that covers transportation accidents, medical emergencies, and personal belongings before using our services.

7. Review Policy

Reviews submitted through our platform must be honest, respectful, and based on personal experience. We reserve the right to moderate, edit, or remove reviews that violate our guidelines, including those that contain:

• Offensive or discriminatory language
• False or misleading information
• Spam or promotional content
• Personal attacks

8. Intellectual Property

All content on TourFixer, including text, graphics, logos, and software, is owned by us or our licensors and protected by copyright laws. You may not copy, reproduce, or distribute any content without our written permission.

9. Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our control, including natural disasters, war, pandemics, government actions, or technical failures.

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes constitutes acceptance of the new terms.

11. Governing Law

These terms are governed by the laws of the Republic of Uzbekistan. Any disputes shall be resolved in the courts of Uzbekistan.
